1. Who we are
Summit Sereniti is a trading name of ERV Limited, a company registered in England under company number 16932466 with its registered office at 19A Grange Road, West Kirby, Wirral, CH48 4DY. You can contact us at info@summit-sereniti.co.uk or on 07442 368028.
2. How these terms apply
These terms apply to all bookings made with Summit Sereniti (a trading name of ERV Limited) via our website, enquiry form, email or phone. By confirming a booking, you agree to these terms.
3. Our commitment to you
We'll provide a fully qualified, insured therapist and deliver the service with reasonable care and skill. We'll do everything we can to arrive and deliver on time, but in rare cases (illness, traffic, or circumstances outside our control) we'll contact you as soon as possible and agree next steps together.
4. What we need from you
• A safe, suitable space for the massage chair (not required for desk massage or Indian head massage).
• Reasonable access for setup and pack-down.
• Any furniture moving needed to create the space is the client's responsibility, not ours.
5. Health and suitability
It's the client's responsibility to disclose any relevant medical conditions, injuries, or pregnancy in advance so we can assess suitability. Our therapist may decline or stop a treatment at their professional judgement if there's a risk to someone's health or safety. We can't be held responsible for issues arising from conditions that weren't disclosed beforehand.
6. Our therapists, insurance and liability
6.1 Your treatment will be carried out by a qualified therapist arranged by Summit Sereniti. Some of our therapists are self-employed professionals who work with us rather than being our employees.
6.2 Each self-employed therapist holds their own public liability and professional indemnity insurance. ERV Limited Trading as Sumit Sereniti holds its own Public Liability Insurance through the agent – Salon Gold with a minimum limit of indemnity of £5,000,000.
6.3 Whoever carries out your treatment, Summit Sereniti remains responsible to you for your booking, including making sure the service is delivered with reasonable care and skill.
6.4 Our therapists may decline or stop a treatment if, in their professional judgement, it isn't safe or suitable for that person, or if anyone behaves inappropriately towards them.
6.5 If you're unhappy with a treatment, please tell the therapist at the time so they can try to put it right. If that doesn't resolve it, please tell us as soon as you can, ideally within 3 days, and we'll look into it promptly, working with the therapist and our insurers where needed. This doesn't affect your legal rights.
6.6 Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited, and nothing in these terms affects your statutory rights as a consumer.
6.7 For business customers only. The extent the law allows, we are not liable to business customers for loss of profit, loss of business or other indirect loss, and our total liability for any one booking is limited to the value of that booking.
7. Fees and payment
Invoices are due within 7 days of the invoice date but not later than the date when the service is booked to be provided. Please raise any dispute with an invoice in writing within 7 days. Any undisputed amount remains due on the original date.
8. Late payment
If an invoice isn't paid within 7 days or prior to the scheduled booked service date, we reserve the right to charge 8% interest on every year of the overdue amount and to pause any further bookings until payment is received.
9. Cancellations by you
Cancellations made more than 7 days before the booking receive a full refund of the deposit; cancellations within 7 days are non-refundable. Nothing in this section affects any statutory cancellation rights you may have as a consumer.
10. Cancellations by us
If we're unable to deliver a booked session, we'll give you as much notice as possible and offer either a different available therapist, a new date, or a full refund of fees paid for that session.
11. Events outside our control
Neither of us is responsible for delays or cancellations caused by events outside our reasonable control, such as severe weather, illness, or circumstances beyond our control.
12. Confidentiality and your data
We treat any personal or business information you share with us as confidential and won't disclose it beyond what's needed to deliver the service. We only use your personal information as set out in our Privacy Policy, available at www.summit-sereniti.co.uk/privacy-policy
13. Ending a booking
We may decline or cancel a booking if payment isn't received as agreed.
14. General and governing law
If any part of these terms is found unenforceable, the rest will remain in effect. These terms are governed by the laws of England and Wales. If a dispute can't be resolved directly, both parties agree to try to resolve it informally before pursuing formal action.
